How can teachers avoid civil rights complaint for student discipline?

There have been recent rashes of civil rights complaints which involve teachers and students. Many of the lawsuits begin as a result of teachers reporting student behavior. Teachers can avoid civil rights complaints that involve student discipline by utilizing the Raccelerate Racism Formula and the Raccelerate Racism Scale.

According to the Department of Education Office of Civil Rights, if a person believes that a public school, a public or private college or university which includes vocational schools that receive federal funds has discriminated against someone on the basis of race, color, national origin, sex, or age can file a civil rights complaint. The persons must file a complaint within 180 days of the alleged discrimination. Even though many institutions have a grievance process, the individual does not have the process and can file the civil rights complaints as a first alternative.

When a civil rights compliant is filed the investigation includes assessing teacher referrals for discipline. For example, the U.S. Office of Civil Rights visited six Winston-Salem/Forsyth County schools to review whether discipline policies, especially for black male students were excessive. The schools were asked to describe how they handle discipline, at what point discipline matters are turned over to an assistant principal and who enters discipline information into the computer system. In most cases, the discipline process begins with the submission of a discipline referral from a teacher.

Teachers can use the Raccelerate Racism Formula to avoid civil rights complaints. The Raccelerate Racism Formula is birthed from the Raccelerate Phenomenon. The Raccelerate Phenomenon has roots in Newton’s Third Law of Motion. Newton’s Third Law of Motion states that when one body exerts a force on a second body, the second body simultaneously exerts a force equal in magnitude and opposite in direction on the first body. In elementary terms, Newton’s Third Law of Motion states that for every action there is an equal and opposite reaction.

The Raccelerate Phenomenon follows the same principle as Newton’s Third Law of Motion in that whenever there is a perceived infringement by a Black male against a White female there is an negative overreaction portrayed in the media. Specifically, the Raccelerate Phenomenon states that for every action that a Black male takes against a White female there is an elevated negative reaction towards Black men. The Raccelerate Phenomenon is the cause for many of the racial tensions between Blacks and Whites.

The Raccelerate Phenomenon has an impact on the education, unemployment, incarceration, and poverty level of Black men. Presently there are over 125 million and 20 million White women and Black men respectively in the United States. The graduation rate for White women is 88%. the graduation for Black men is 52%. The unemployment rate for White women is 7.1%. The unemployment rate for Black men is 13.3%. The prison rate for White women is 15%. The prison rate for Black men is 64%. The poverty rate for White woman is 11.6%. The poverty rate for Black men is 35%.

Teachers can protect themselves from civil rights complaints by utilizing the Raccelerate Racism Formula. The teacher version for the formula is:

RRF = Ln ((Number of Student Discipline Referrals)/ Total Number of Students) + 5.4

Ln = Natural Log

The Raccelerate Racism Scale is a 0 to 10 numerical scale.

RRF
0-1 Not Racist
1-2 Slightly Racist
2-3 Moderately Racist
3-4 Highly Racist
4-10 Extremely Racist

Schools can also protect themselves from civil rights complaints by using the following formula:

RRF = Ln ((Number of Students Suspended)/ Total Number of Students) + 5.4

Ln = Natural Log

As society in the United States increases their sensitivity in the area of racism, teacher can use the Raccelerate Racism Formula to ensure that they are not victimized by allegations associated with civil rights complaints.

Racism is a menace and so we’ve been taught for ages which is the primary need for a diversity expert. However, even in this modern society of today where we see a lot of colored celebrities performing on stage with huge fan followings and of course an Afro-America President for the USA, we are still in a phase where racism exists in all its brutal glory and has been eating away at the society like a plague. Teachers need to recognize the biases that exist within the classroom and also take conscious measures to address them and their own biases of course. James Baldwin once said, “it is your very own responsibility to change this society, if you think of yourself as an educated person.” Dr. Derrick L.
